1. About findmygrail & role of the platform
findmygrail is an online marketplace platform that connects buyers and sellers of collectibles in Australia. We are a platform provider and intermediary only — we are not a party to any transaction between users, we do not take custody of or hold any items, we do not process or hold payments between buyers and sellers, and we do not guarantee the authenticity, condition, legality, or existence of any listing. We simply provide tools for users to list, discover, and communicate about collectibles.
2. No liability for user transactions
All transactions, agreements, and arrangements between buyers and sellers are entirely between those parties. findmygrail is not involved in any transaction and accepts no responsibility or liability for any loss, damage, dispute, or issue arising from or in connection with any transaction, communication, or interaction between users. This includes but is not limited to: non-delivery of items, misrepresentation of items, counterfeit or inauthentic items, payment disputes, failure to pay, or any breach of agreement between users. You transact with other users entirely at your own risk.
3. No liability for fraudulent or illegal activity
While we use AI-powered moderation and other measures to detect and prevent prohibited listings, these tools are provided on a best-effort basis and are not guaranteed to identify every violation. findmygrail is not liable for any fraudulent, illegal, or prohibited activity conducted through the platform, including but not limited to the listing or sale of counterfeit goods, stolen property, illegal items, or any activity that violates Australian law. Users who engage in fraudulent or illegal activity are solely responsible for their actions. findmygrail reserves the right to remove content, suspend accounts, and report violations to authorities, but accepts no liability for any harm caused by such activity before or after detection.
4. Your account
You must be at least 18 years old to use findmygrail. You are responsible for keeping your account credentials secure and for all activity under your account. You agree to provide accurate information when creating listings and communicating with other users.
5. Seller responsibilities
Sellers are responsible for the accuracy of their listings, including item condition, authenticity and provenance. You must not list counterfeit, stolen, or prohibited items. You are responsible for arranging and fulfilling postage or pick-up, and for setting your own postage costs and methods. Sellers are solely responsible for any tax obligations arising from their sales, including GST registration where their annual turnover exceeds Australian Taxation Office thresholds.
6. Buyer responsibilities
Buyers are encouraged to research items, review seller ratings, and ask questions before making an offer or arranging a purchase. Transactions are between buyers and sellers; findmygrail does not guarantee delivery, authenticity, or refunds. Buyers are solely responsible for verifying the authenticity and condition of items before completing any transaction.
7. Prohibited items
Counterfeits, weapons, illegal drugs, unregulated gambling materials, hate speech items, and any items prohibited under Australian law are not permitted. Listings are AI-scanned; suspicious listings are held for admin review and may be removed without notice. AI moderation is a best-effort tool and may not detect all violations. Repeated violations may lead to account suspension. The platform is not liable for any prohibited items that are listed despite our moderation efforts.
8. Indemnification
You agree to indemnify and hold harmless findmygrail, its operators, and affiliates from any claim, demand, loss, damage, or expense (including legal costs) arising out of or in connection with your use of the platform, your listings, your transactions with other users, or any breach of these terms by you.
9. Fees & GST
During our launch period, selling on findmygrail is free. Every seller receives 5 free listing promotions. Additional promotional features may become available for purchase in the near future. We do not charge commissions on individual sales. All prices on the platform are in Australian dollars (AUD). Transactions between buyers and sellers are private arrangements; sellers are responsible for their own tax obligations, including GST where applicable.
9a. Market price estimates
Our 'Check indicative price' tool provides AI-generated market price estimates to help guide your listing price. Estimates are indicative only, based on third-party marketplace data (such as eBay, TCGplayer and PriceCharting), and are not a formal valuation or guarantee of value. We do not warrant the accuracy of any estimate and recommend you conduct your own research before setting a price.
10. No warranty & Australian Consumer Law
findmygrail is provided 'as is' without warranties of any kind. We do not guarantee uninterrupted access, error-free operation, or the accuracy of listings. You use the platform at your own risk. Nothing in these terms excludes, restricts or modifies any consumer guarantees, rights or remedies conferred by the Australian Consumer Law (including guarantees of acceptable quality, fitness for purpose and correspondence with description) where they cannot lawfully be excluded. Where any such guarantee applies, our liability is limited, to the maximum extent permitted by law, to resupplying the service or paying the cost of having the service resupplied.
11. Limitation of liability
To the maximum extent permitted by law, findmygrail shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including any loss arising from transactions with other users, fraudulent activity, illegal listings, or any other user conduct. Our total liability for any claim arising from your use of the platform is limited to the amount you have paid us in the preceding 12 months, or where you have not paid us, to resupplying the service.
12. Reporting & disputes
You can report a listing or seller using the report function on each listing. Disputes between buyers and sellers are the responsibility of the parties involved and should be resolved directly between them. findmygrail does not mediate, arbitrate, or resolve disputes between users, and is not liable for the outcome of any such dispute. We may suspend or terminate accounts that violate these terms.
13. Governing law
These terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales.
